This Privacy Policy (the "Policy") governs the manner in which Inner Balance Academy ("We") on the Platform innerbalanceacademy.in collects, uses, maintains, and discloses information from its users. It also describes the practices we apply to such information, your privacy rights, and the choices you have regarding your data.

This Policy applies to all users of the Platform (referred to as "Learners", "You", "Your").

By accessing and using the Platform, you consent to the collection, use, and disclosure of information as described in this Policy and our Terms of Use. If you do not agree, please do not access or use the Platform.

If any information you have provided violates the terms of this Policy, we may delete that information and revoke your access if required, without incurring any liability to you.

Section 01

Personal Information

"Personal Information" means information which identifies a Learner — i.e., first and last name, identification number, email address, age, date of birth, gender, location, photograph, and/or phone number provided at the time of registration or any time thereafter on the Platform.

"Sensitive Personal Information" includes:

  • Passwords and financial data (except truncated last four digits of card numbers)
  • Health data
  • Official identifiers such as Aadhaar, social security number, driver's licence, passport, or biometric data
  • Information about sexual life, racial or ethnic origin, political or religious beliefs
  • Account details, PAN, or other data classified as 'sensitive' under applicable Data Protection Laws including DPCP 2023, GDPR, and CCPA

Usage of the term "Personal Information" includes "Sensitive Personal Information" where applicable to the context.

We may collect both personal and non-personal identifiable information in a variety of ways. Please note:

a) Personally Identifiable Information

We may collect your name and email address to enable access to the Platform. This information is collected only if voluntarily submitted by you. You can refuse to provide it, though this may limit your access to certain features.

b) Non-Personally Identifiable Information

When you interact with our Platform, we may automatically collect non-personal information such as browser type, language preference, referring site, operating system, IP address, date/time of requests, and similar technical data. In the event of an app error, we may also collect Log Data (IP address, device name, OS version, app configuration, usage time and statistics).

c) Cookies

To enhance user experience, the Platform may use cookies. You may set your browser to refuse or notify you of cookies, though some parts of the Platform may not function properly if cookies are disabled. Third-party code and libraries used on the Platform may also use cookies independently.

We use your information to allow you to access the Platform, provide customer service, fulfil purchases, verify user information, and resolve technical issues. The legal basis is consent or our legitimate interests in administering the Platform.

b) To Conduct KYC Verification

Where applicable laws or regulations mandate verification, we may use your information for KYC purposes. The legal basis is consent or our legitimate interests.

c) To Improve Platform Safety

We use your information to improve and customise the Platform and to detect, investigate, and prevent fraud, misuse, or violations of third-party or our rights. The legal basis is consent or our legitimate interests.

d) To Communicate With You

We may use your email address to communicate about orders, offers, new content, and to respond to enquiries. You can unsubscribe from marketing emails at any time by writing to us. The legal basis is consent or our legitimate interests.

e) Service Providers

We may engage trusted third-party companies for the following purposes: to facilitate our service; to provide services on our behalf; to perform service-related work; or to help us analyse platform usage. These third parties have access to your Personal Information only to perform their assigned tasks and are obligated not to disclose or use it for any other purpose.

We do not use your Personal Information for automated decision-making or profiling beyond what is described in this Policy. We do not sell, trade, or exploit your personally identifiable information. We may share generic aggregated demographic information (not linked to any individual) with trusted business partners.

You may nominate another person to exercise your rights on your behalf in the event of your death or incapacity.

You may request the deletion of your Personal Information from our Platform. Please note this will permanently delete your account and cannot be undone.

You may only exercise these rights in respect of your own information. When we receive requests by email, we may ask you to verify your identity before processing them, in accordance with applicable Data Protection Laws.

We take all reasonably necessary measures to protect against unauthorised access, use, alteration, or destruction of Personal Information. Our disclosure of such information is limited to:

  2. A response to a court order or other governmental request. We reserve the right to disclose information where we believe in good faith it is necessary to:
    1. Comply with applicable laws, regulations, court orders, or law enforcement requests.
    2. Protect and defend a third party's or our rights and property, or the safety of our users or employees.
    3. Prevent, detect, investigate, and take measures against criminal activity, fraud, or misuse of the Platform.

To the extent permitted by law, we will attempt to give you prior notice before disclosing your information in response to such a request.

Third-Party Websites

The Platform may contain links to websites of our partners, suppliers, advertisers, sponsors, or other third parties. We do not control the content of these sites and are not responsible for their practices.

These external sites may have their own terms of use and privacy policies. Browsing and interaction on any other website — including those linked from our Platform — is subject to the terms and policies published on those sites.

Cross-Border Data Transfer

Your information, including any Personal Information, is stored, processed, and transferred in and to Amazon Web Services (AWS) servers and databases located in India. We may also store or process information on servers in other countries depending on the location of our service providers.

Countries outside India may have different (and potentially less stringent) privacy laws. Personal Information may become subject to the laws and disclosure requirements of such countries.

If you use our Platform from outside India — including from the USA, EU, EEA, or UK — your information may be transferred to and processed in India. By accessing the Platform, you consent to this transfer.

Duration of Data Storage

We retain your information for as long as needed for the purposes stated in this Policy, including legal obligations and business compliance requirements.

We may not be able to delete all publicly posted content (e.g. comments or feedback), but we will anonymise your Personal Information so you can no longer be individually identified. We will never disclose aggregated or de-identified information in a way that could identify you.

Unless stated otherwise, the current Policy applies to all information we hold about you.

Additional Rights by Region

Depending on where you are located, you may have additional rights under local legislation. Click your region to read the details that apply to you.

If you are located in India, you may have the following rights under the Digital Personal Data Protection (DPDP) Act, 2023. All requests can be made via the Platform upon login, or by writing to us as stated in the Grievances section.

  1. Right to Confirmation & Access: Confirm whether we hold your Personal Information and access it along with supporting information.
  2. Right to Correction: Ask us to rectify inaccurate, incomplete, or outdated Personal Information.
  3. Right to Grievance Redressal: Register a grievance with us concerning the handling of your Personal Information.
  4. Right to be Forgotten: Restrict or prevent continuing disclosure of your Personal Information under certain circumstances.
  5. Right to Erasure: Request deletion of your Personal Information from our Platform. This will permanently delete your account and cannot be undone.

If you are located in the UK, EU, or EEA, you have the following rights under GDPR. All requests should be sent to the address in the Grievances section.

  1. Right to Access: Receive confirmation of whether your Personal Information is being processed and, if so, access to it.

We collect and process Personal Information only where we have a legal rationale to do so, determined by the type of data and context of processing.

CCPA Notice at Collection

We collect the following categories of Personal Information:

  • Identifiers: Name, email, mobile number, username, unique identifier, IP address.
  • California Customer Records data: Name, email, username, unique identifier, gender.
  • Internet / network activity: Cookies, browser type, IP address, page visit data, access time.
  • Geolocation data: IP address (approximate location).
  • Audio/visual information: Profile pictures or audio/visual content uploaded to the Platform.
  • Inferences: Inferences drawn from collected data (e.g. likelihood of retention).

Data Practices in the Last 12 Months

Collected: Identifiers, Customer Records data, internet activity, geolocation, commercial information, audio/visual information, and inferences.

Sources: From you and our payment processors.

Purpose: To operate the Platform, provide services, communicate with you, analyse usage, enhance experience, and ensure security.

Sold: We have not sold any Personal Information during the preceding 12 months.

Disclosed for business purposes: To corporate affiliates, advisors, service providers (analytics, storage, marketing, technical support), and operating systems/platforms.

Submitting a CCPA Request

You may submit a Request to Know or Request to Delete by emailing us at sushantaeft@gmail.com. We will verify your identity before processing any request. Authorised agents may submit requests with signed permission. Excessive or repetitive requests may incur a reasonable administrative fee.

We do not discriminate against users who exercise their CCPA rights. We do not offer financial incentives linked to personal data.
