This Privacy Policy (the "Policy") governs how Sushanta Kumar Padhan | Inner Balance Academy™ ("we", "us", "our") collects, uses, maintains, and discloses information from users of the Platform at www.innerbalanceacademy.in ("Platform").

Personal Information — Definitions

"Personal Information" means information that identifies a Learner — first and last name, identification number, email address, age, date of birth, gender, location, photograph, and/or phone number provided at registration or thereafter on the Platform.

"Sensitive Personal Information" includes: (i) passwords and financial data; (ii) health data; (iii) official identity documents (Aadhaar, PAN, passport, driver's license, biometric data); (iv) information about sexual life, race, ethnicity, political or religious beliefs; (v) account details and passwords — as categorized under the IT Rules 2011, DPDP Act 2023, GDPR, and/or CCPA ("Data Protection Laws").

The term "Personal Information" includes "Sensitive Personal Information" where applicable to the context of its use.

Information We Collect

🛡️ Our three core commitments: (1) We don't ask for Personal Information unless we truly need it. (2) We don't share it with anyone except as required by law or to operate the Platform. (3) We don't store it on our servers longer than necessary.

a) Personal Identifiable Information: We collect your name and email address to enable Platform access. This is collected only when voluntarily submitted. You may refuse, but this may limit access to certain services.

b) Non-Personal Identifiable Information: When You interact with our Platform, we may automatically collect browser name, language preference, referring site, date/time of requests, operating system, IP address, device name, OS version, and other usage statistics — typically through third-party tools in case of app errors (Log Data).

c) Cookies: Our Platform may use cookies to enhance Your experience. The Platform itself does not use cookies explicitly, but third-party code and libraries embedded in the Platform may use cookies to improve their services. You may set Your browser to refuse cookies, though some Platform features may not work properly as a result.

How We Use & Share Information

We may collect and use Your Personal Information for:

  1. Platform Access & Services: To allow You to access the Platform, provide customer service, fulfil purchases, verify user information, and resolve technical issues.
  2. KYC Verification: Where applicable laws or regulations mandate KYC verification of Learners.
  3. Platform Improvement & Safety: To improve and customize Platform services, prevent criminal activity, fraud, misuse, and protect the rights and safety of users and third parties.
  4. Communication & Marketing: To communicate about orders, offers, new products/services, and respond to inquiries. You may unsubscribe from marketing emails at any time by writing to us.
  5. Service Providers: We may employ third-party companies to facilitate our services, provide services on our behalf, or assist in analyzing Platform usage. These third parties have access to Personal Information only to perform assigned tasks and are obligated not to disclose or use it otherwise.

Your Rights

All Learners have the following rights. You may exercise them via Platform login options or by writing to us at the Grievances contact below.

  1. Right to Confirmation & Access: You may request confirmation and access to Personal Information we hold about You.
  2. Right to Correction: You may request rectification of inaccurate or incomplete Personal Information.
  3. Right to Nominate: You may nominate another person to exercise Your rights in the event of Your death or incapacity.
  4. Right to Erasure: You may request deletion of Your Personal Information. Note: this may result in permanent deletion of Your account and cannot be reversed.
Rights apply only to Your own information. We may request identity verification before processing any rights request.

Protection of Your Information

We take all reasonably necessary measures to protect against unauthorized access, use, alteration, or destruction of Personal Information. Disclosure is limited to:

  1. Employees, contractors, and affiliated organizations who need the information to operate the Platform and have agreed to confidentiality obligations.
  2. Government or court orders where legally required. We will attempt to give You prior notice where permitted by law before such disclosure. We may also disclose to protect rights, safety, and to detect/prevent fraud or criminal activity.

Third-Party Websites

The Platform may contain links to third-party websites. We do not control their content or privacy practices and are not responsible for them. Use of any linked website is at Your own risk and subject to that site's own terms and privacy policy.

Cross-Border Data Transfer

Your information, including Personal Information, is stored, processed, and transferred on Amazon Web Services (AWS) servers located in India. We may also store or process data on servers in other countries depending on our affiliates and service providers.

If You access the Platform from outside India (including the USA, EU, EEA, or UK), Your information may be transferred to and processed in India. By using the Platform, You consent to this transfer.

Data Retention

We retain Your information for as long as necessary for the purposes stated in this Policy, including compliance with legal and business obligations.

We may not be able to delete all publicly posted content (e.g., comments, feedback), but we will anonymize Your Personal Information so You can no longer be individually identified. We will never disclose aggregated or de-identified information in a manner that identifies You.

Personal Information Sold: We have not sold any categories of Personal Information in the preceding 12 months.

CCPA Non-Discrimination: We do not discriminate against users for exercising their CCPA rights.

Authorized agents may submit requests with signed permission from the consumer or power of attorney under California Probate Code.
